KEY ASPECTS OF THE LAW ON TRANSPORT DELAY PAYMENT
The law on transport delay payment is a regulation that was approved in 2021 to address the persistent issue of overdue payments affecting many companies in the freight transportation sector. It was not until late 2022 that the National Inspection Plan was implemented, which is why it is currently a hot topic. Below, we will explain the main elements of this law.
- Payment deadlines. It establishes a maximum payment deadline, usually 60 days from the date of service. This limit is mandatory and cannot be altered through private agreements between parties.
- High penalties. It imposes sanctions and interest on late payments. These penalties are aimed at deterring delinquency and can range from €401 to €30,000.
- Administrative changes. It provides a mechanism for dispute resolution and claims, offering transport companies a legal means to resolve payment conflicts. This mechanism includes the possibility of claiming payment for legal costs in litigation cases.
- Compromised reputation. This is a potential consequence of the law. Reputation is an essential requirement to operate within the sector. If it is lost, it could result in the disqualification of the company and have serious consequences.
BENEFITS FOR THE TRANSPORT SECTOR
The primary benefit of the Law on Transport Delay Payment is the financial protection it provides to transport companies. By limiting payment delays and penalizing delinquency, the law safeguards the liquidity and solvency of transport companies, enabling them to plan and operate with greater financial security. Furthermore, the law contributes to a fairer and more equitable business environment, where large companies cannot abuse their position of power to impose unfavorable payment conditions on transport companies. This ensures that all transactions are completed within the 60-day timeframe from the invoice date.
CHALLENGES ON THE WAY: IMPLEMENTING THE LAW ON TRANSPORT DELAY PAYMENT
Despite its benefits, implementing the Law on Transport Delay Payment also poses some challenges. One of the main challenges is compliance and enforcement of the law. Ensuring that all companies comply with the regulations and penalizing those that do not can be a complicated and costly process, especially when dealing with companies with significant billing volume.
