WORKING HOURS IN ROAD TRANSPORT
09/24/2024
Discover how the working hours of road transport drivers are regulated and what is the main tool that controls driving and rest hours.
Road transport is a fundamental sector in the global economy, but it is also one of the most regulated due to the need to ensure road safety and protect the labor rights of drivers. In this context, the working hours of road transport drivers and the use of the tachograph are key aspects. In this article, we will explore the labor regulations applicable to drivers, how their working hours are regulated, and the importance of the tachograph as a tool for recording and controlling these hours.
Labor Regulations for Road Transport Drivers
The labor regulations governing the working hours of road transport drivers are designed to ensure both road safety and workers' well-being. The main regulations at the European level are established in Regulation (EC) No 561/2006, which harmonizes the rules on driving times, breaks, and rest periods.
Driver's Working Hours
A driver's working day cannot exceed 9 hours per day; however, there is the possibility of extending it to 10 hours only twice a week.
As for the weekly working time, it cannot exceed 56 hours, and the total accumulated over two weeks cannot exceed 90 hours.
It is essential for drivers to respect these limits to avoid penalties and, above all, to preserve their health and safety.
Breaks and Rest Periods in Transport
According to the regulations, after 4 hours and 30 minutes of driving, the driver must take a break of at least 45 minutes. This break can be split into two: a first break of 15 minutes and a second of 30 minutes, as long as the driving times are respected.
Additionally, the driver is entitled to a daily rest period of at least 11 consecutive hours, which can be reduced to 9 hours three times between two weekly rest periods. Regarding the weekly rest period of 45 hours, it can be reduced to 24 hours every two weeks, but the difference must be compensated within the next three weeks.
And what if there are two drivers? What would the driving times be?
In this case, after the first driver's four and a half hours, they can be replaced by the second driver, and therefore, the 45-minute break is not required. However, as clearly stated in Article 8 (paragraph 5) of the Regulation stated above, both drivers must respect the 9 hours of continuous rest.
Recording Working Hours: The Tachograph
The tachograph is an essential tool in road transport, as it allows for the precise recording of driving times, breaks, and rest periods of drivers. It is a mandatory device in all heavy goods and passenger transport vehicles, as established by European regulations.
How the Tachograph Works
The tachograph automatically records the driver's activity and rest times through a personal card that must be inserted into the device before starting the workday. This system allows both employers and control authorities to verify compliance with the regulations on driving and rest times.
Consequences of Not Complying with the Regulations
Failure to comply with the regulations on driving and rest times can result in penalties for both drivers and companies. Penalties may include heavy fines, vehicle immobilization, and even the withdrawal of the driver's license in severe cases. Moreover, inadequate rest increases the risk of traffic accidents, endangering not only the driver but also other road users. Therefore, it is essential to respect the regulations and use the tachograph correctly.
In short, the working hours of road transport drivers are subject to strict regulations aimed at ensuring road safety and workers' health. The tachograph is known as an indispensable tool for recording and controlling these times, ensuring compliance with established regulations. Knowledge and adherence to these regulations not only prevents penalties but also contributes to a safer and more efficient work environment.
